Union Report 3/18/20 – Shelter in Place Orders vs. “Essential Government Functions”

To the Membership

On March 11, 2020 the Union and LM Space signed an agreement securing pay for lost time to members impacted by the Corona Virus (COVID 19) using the KNDS absence code.

On Monday 3/16/2020, several bay area counties called to shelter at their place of residence.  Schools and non-essential businesses were closed/ . LM Space notified all employees via LM Notify system that they would be closed on Tuesday March 17th, in accordance with the Santa Clara County Order.

The Santa Clara County Order begins with the following:

Please read this Order carefully. Violation of or failure to comply with this Order is a misdemeanor punishable by fine, imprisonment, or both. (California Health and Safety Code  § 120295, et seq.)

The order included exclusions under article 10 D:

10 D           “Each governmental entity shall identify and designate appropriate employees or contractors to continue providing and carrying out any Essential Governmental Functions. All Essential Governmental Functions shall be performed in compliance with Social Distancing Requirements as defined in this Section, to the extent possible. “

On March 17th 2020 in the evening the Company called all of our members back to work on March 18th, 2020, after receiving the waiver deeming all work as essential government functions.
